3. Lapalmavierundzwanzig, S.L. - Advertising portal for the brokerage of long-term rental properties and services

Lapalmavierundzwanzig, S.L. is the provider of an online portal for the brokerage of long-term rental properties. Users can check the availability for long-term rental properties according to their wishes and specifications. Lapalmavierundzwanzig, S.L. provides a non-binding offer at the request of the user and sends this to the email address given by the user. If the property is available and the user accpet the offer, sent by Lapalmavierundzwanzig, S.L., a contract is concluded between the user and the respective provider. Lapalmavierundzwanzig, S.L. acts exclusively as an advertising portal for the provider and is not involved as a contractual partner in the contractual relationship between the provider and the user. The services of Lapalmavierundzwanzig, S.L. ends with the despatch of the confirmation documents. Lapalmavierundzwanzig, S.L. accepts no liability for the performance of the services presented on the website and does not assume any guarantees for the suitability or quality of the services shown on the website.

4. Payment

The rental payments are made exclusively between the user and the respective provider. If a rental property is successfully brokered, we collect a commission from the owner.

If the mediation is successful, the tenant pays a processing fee of 50 euros to Lapalmavierundzwanzig S.L.

If the medation is successful, the owner of the property pays a commission to Lapalmavierundzwanzig S.L., which is staggered as follows:
10% on the total rental price for rentals of up to eight months
One month's rent for a rental period of nine months or more.

The commission payment of one month's rent is the maximum that is charged to the owner. If the rental period is extended from e.g. three to nine months, only the difference has to be paid.

Our entitlement to a commission arises even if the contracting parties start direct negotiations through our work, regardless of whether a contract is concluded now or later.

5. Use of the website

This website is available to the user for their own use and is only to be used in a legally permissible manner.

The following shall apply:
a) The user must be minimum 18 years old and must have fully legal capacity.
b) You assure that all information that you provide about yourself or passengers, is true and correct.
c) It is not allowed to use the website for speculation purposes, or fraudulent or false bookings.
d) It is not allowed to reproduce, sell, transfer, publish or reproduce the website and its contents by the user. For your personal or non-commercial use, making of a single copy of the page is permitted.
e) The user agrees to indemnify Lapalmavierundzwanzig, S.L., their partner companies and employees against all claims by third parties (including reasonable costs of legal action), which arising from an abusive, or otherwise illegal non-conforming use of the website and its contents by the user.

In the case of any dispute concerning the fulfilment and implementation of this contract, the parties of this contract agree expressly submit to the jurisdiction of the judicial authorities of the Province of Santa Cruz de Tenerife and expressly waiving any other jurisdiction that may correspond to them.
